Tennessee BUI or Tennessee Boating Under the Influence

 

Tennessee is a beautiful state with many lakes and rivers where Tennesseans routinely enjoy spending time with friends and loved ones.

Unfortunately, while enjoying themselves, many people find themselves facing a Tennessee BUI or Tennessee Boating Under the Influence charge.  In Tennessee, Boating Under the Influence or BUI is a Criminal Offense that can become part of your permanent criminal history. A Tennessee BUI charge can also lead to the suspension of your driving privileges, similar to a Tennessee DUI charge.

 

Boating Under the Influence in Tennessee is defined by statute as:

 

“It is unlawful for any person or persons to operate any vessel subject to registration or any commercial vessel as defined in this section on the public waters of the state while under the influence of any intoxicant, marijuana, narcotic drug, or drug producing stimulating effects on the central nervous system.”

 

Similar to Driving Under the Influence in the state of Tennessee, the law has created a presumption that anyone who registers a .08 or greater on a blood, breath or urine test is presumed to be Boating Under the Influence of alcohol or a drug.

 

Interestingly, one defense to Tennessee Boating Under the Influence is to have a boat or vessel that is anchored or moored.
